It would seems the "law" is unconstitutional, and wouldn't apply to anyone who is "peaceful". One thing this arrest points out that's pretty darn sad is apparently he talked to someone with a grudge who turned him in.

I really don't see how they can prosecute anyone for the so-called 'insurrection'. The US Capitol is a public building, with the exception of some of the offices.

There were some that crossed the line to a criminal act, mostly vandalism and theft with possibly a few assaults. That's a crime anywhere and if there's solid evidence against them one should have a problem with their conviction. Beyond THAT there is only one area of the law specifically written by the Founders to prohibit the interference of legislators from performing their duties. This was done due to the real threat at times to kidnap, arrest, etc. state or federal officials on the way to the capital or seizing their documents. That's considered a serious offense and therefore should have clear evidence in order to convict. Unfortunately I think that's what a few "rioters" intended to do and if they stated their intent to any witnesses they better hire an excellent attorney. en.wikipedia.org/wiki/Speech_or_Debate_ClauseAll the rest are covered by the 1st Amendment and THEIR lawyers need to aggressively remind the entire court (judge, prosecutor and jury) that the right to peacefully protest is EQUALLY deserving of protection as legislators themselves. That's one of the most propagandized aspects of the whole January 6th left wing politician and media frenzy about the "disturbance" at the Capitol. Although the media and politicians keep using the word "insurrection", not one of the accused is charge with that. The legal term insurrection requires a good deal more violence and conspiracy than exhibited J6.
The DOJ should be ashamed of themselves for the contrived charges they've brought against basically tourists who happen to support Trump.
