It's always in your best interest to comply with the officers requests, I'm not sure why some people can't understand that.
We just had a officer involved shooting here this afternoon. Twitter reports are saying the suspect was shot 6 times, ouch

Yeah, not a great idea to not follow instructions when pulled over.
As far a the man getting out of his truck, does that differ state to state? I was taught (in health classes all throughout my education) that the driver and passengers were to remain in the vehicle unless otherwise instructed. Everyone in the vehicle should have their hands visible, the driver should have their hands on the steering wheel at 10 and 2. Do other states have laws that the driver gets out of the vehicle when pulled over?

Both ID and OR - stay in the vehicle, keep your hands visible, don’t go reaching for papers, etc until you’re asked to. Be polite, don’t argue. I’ve been pulled over lots of times, only had one ticket about 30 yrs ago. |

As said when stopped in a motor vehicle put hands on wheel don’t unfasten seat belt. That can be a big mistake. If cop asks do you know why I pulled you over the answer is a big NO ! In fact you really don’t know he could just not liked the color of your car.
Also passengers are by law not required to id unless they can state a crime they are suspected of committed.

Right, but if the cop may be clueless or even perhaps a bad cop, it’s even more important not to push his buttons. Cheaper and less painful to sort it out in court. None of these of course are answers to the original question. Answer? The civil rights violation occurred at the moment the blue lights were turned on, 4th amendment, probable cause. Naturally if the only witness is dead, it's hard to proceed with any case which is why the advice to survive the confrontation is important. This same city, same dept., is now trying to settle a similar civil rights lawsuit, except the victims are very much alive and the dash cam clearly shows the Mustang at the traffic light turning left on a green arrow WITH its left blinker on. They were pulled over for NOT using a signal, which is ridiculous on its face if you're in a left turn lane and you have the green arrow anyway. Video is so convincing, lol. Nevertheless this is so common it's not worth my time talking about. Know the law, know your rights and be careful because not all cops are good guys. 🤣🤣🤣 Wow, that gal was really working at not getting a ticket. I was laughing so hard listening to her. Cop probably was too. I’ve been around some pretty hot cops but don’t recall ever telling them so when I got pulled over. 😁 |

I was pulled over because I stopped at a stop sign and only put one foot down. I didnt plant both feet flat on the ground. So young cop sees older bearded man on a motorcycle and decides I must have something illegal. Because he walks up and the first thing out of his mouth? "Hello you have your license and insurance? And Im gonna need to take a look inside of those bags" And my reply was sure I have my license and my insurance and no you will not be looking inside my locked bags" and he immediately goes into tough guy mode. I asked why he pulled me over and he tells me. I explain that in this state and in this town there is no law statute etc that requires even one foot down much less two feet down. In fact if I had stopped and sat there with no feet down it wouldnt have broken the law. Mind you all of this was said with a chuckle and no stern voice etc. He goes into a rage. Calls his buddy to come back him up. I explain to them both that Im just a guy on his bike headed to tractor supply to get some chicken wormer and theres no need for hysterics on their part. I was commanded to "open those f****ng bags or go to jail" and I said "you wanna cuff me behind my back or in front?" So then a 3rd cop arrives. Older guy. I know him in passing. Been on the force for about 15yrs. He asked them what was going on? They tell him. He proceeds to chew them pretty hard about the whole thing. He sends them off and comes up to me and apologizes and tells me "these young guys are gonna be the death of me. Im retiring in about 4 mos because I get tired of all these young kids they keep hiring stirring up unwarranted trouble" For the next 2 yrs every time I went through town that one cop would follow me everywhere that I went. He was just hoping and praying to catch me forgetting to use a signal etc. Meanwhile everyone in town can point them to several houses that peddle drugs etc. But nope theyre out trying to arrest people like me.
If you are in disagreement with the cop. Let a lawyer sort it out. You can make a stand for your rights and I encourage that you do. But stop short of a physical confrontation or threatening acts that can get you killed

homecreek, Many years ago I was riding north from the Big Bend in Texas when I came up to a border patrol checkpoint in the middle of nowhere. Having sort of a warped sense of humor, just as I stopped at the two officers I reached around and slapped the trunk and said "quiet Miguel, it's the cops". They saw no humor at all in that, and proceeded to go through my bags with fine tooth combs. One found my pistol in my tank bag and acted like he'd found a ton of dope, but I reminded him this was Texas and carrying a gun in a bag was common and legal. Apparently searching a vehicle within so many miles of the border is legal without permission. Seems like a sense of humor isn't part of the requirements for cops.

That’s one of the things I like about you…we have the same warped sense of humor.😆 You haven’t met my cop friends…a couple are more serious but most have a wicked sense of humor and LOVE playing practical jokes. |

would you believe im 85 and have never had a ticket for anything? closest to it was while working at the factory local chief followed me in to where i parked at noon. came up to me and said did you know ive been chasing you for a mile? some of your work buddies called the station and reported your tags were expired. better renew next payday. sure disappointed some of my friendly co workers.
